Terms like privilege, privacy, and confidentiality are often used interchangeably. However, these concepts differ significantly and carry important implications for the work of behavioral intervention teams (BITs) or CARE teams. Understanding these distinctions is crucial, especially when navigating frameworks like the Family Educational Rights and Privacy Act (FERPA), the Health Insurance Portability and Accountability Act (HIPAA), and legal privilege.
NABITA’s Standards for Higher Education set the best practices for information sharing in Standard 7. This standard emphasizes that team members share information according to BIT standard operating procedures and comply with FERPA/privacy/confidentiality requirements (as applicable) when accessing and sharing information.
